By accessing or using Montage by ARI (« the Service »), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.
## 2. Description of Service
Montage by ARI is an automated video editing platform that:
– Processes your raw video footage into edited montages
– Adds AI-generated voice-overs and background music
– Publishes finished videos to your social media accounts (Instagram, Facebook, TikTok)
## 3. Account Registration
### Eligibility
– You must be at least 18 years old
– You must have legal authority to bind your business (if applicable)
– You must provide accurate and complete information
### Account Security
– You are responsible for maintaining the confidentiality of your credentials
– You are responsible for all activities under your account
– Notify us immediately of any unauthorized access
## 4. Social Media Integration
### Authorization
By connecting your social media accounts, you authorize us to:
– Access your profile information
– Publish videos on your behalf when you explicitly click « Publish »
– Store access tokens securely until you disconnect
### Your Responsibilities
You agree to:
– Comply with all terms of service of connected platforms (TikTok, Instagram, Facebook)
– Not publish content that violates platform Community Guidelines
– Not use automated scripts or bots to bypass rate limits
– Ensure you own rights to all content you upload

You must comply with:

## 5. Content Ownership and Rights
### Your Content
– You retain full ownership of videos you upload
– You grant us a temporary license to process your videos (editing, AI analysis)
– This license terminates when your video is published or deleted
### AI-Generated Content
– Voice-overs generated by our AI become part of your content
– Background music is licensed for commercial use
– You receive full rights to the edited videos produced
### Prohibited Content
You may not upload or publish:
– Illegal or fraudulent content
– Copyrighted material you don’t own
– Spam, malware, or phishing content
– Content promoting violence, hate speech, or harassment
– Misleading or deceptive content
**Violation may result in immediate account termination.**
## 6. Service Limitations
### Rate Limits
To comply with platform APIs, we enforce:
– **TikTok**: 3 publications per hour per user
– **Instagram**: 25 publications per day per account
– Excessive usage may result in temporary restrictions
### Availability
– The Service is provided « as is » without guarantees of uptime
– We may perform maintenance with or without notice
– Third-party service outages (OpenAI, TikTok API) may affect functionality
### Quality
– AI-generated content quality may vary based on input quality
– We do not guarantee viral success or specific engagement metrics
– Voice-overs are AI-generated and may have imperfections
## 7. Pricing and Payments
### Free Tier
– Limited to 5 videos per month
– Standard AI voice-overs
– Publication to all connected platforms
### Paid Plans (if applicable)
– Pricing available at betaserver.cabinetmindset.com/pricing
– Billed monthly or annually
– No refunds for partial months
### Payment Terms
– Payments processed via secure payment providers
– Automatic renewal unless cancelled 24h before renewal date
– Price changes communicated 30 days in advance
## 8. Intellectual Property
### Our IP
– The Montage by ARI platform, logo, and branding are our property
– You may not copy, modify, or reverse-engineer our software
– « Montage by ARI » trademark is protected
### DMCA Compliance
If you believe content violates your copyright:

## 9. Disclaimers
### No Warranties
THE SERVICE IS PROVIDED « AS IS » WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
### Social Media Platforms
– We are not affiliated with TikTok, Meta, Instagram, or Facebook
– Platform policy changes may affect our service functionality
– Account suspensions on platforms are outside our control
### AI Limitations
– AI-generated content may contain errors or inaccuracies
– You are responsible for reviewing content before publication
– We do not guarantee content will comply with all platform guidelines
## 10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MONTAGE BY ARI SHALL NOT BE LIABLE FOR:
– Lost profits, revenue, or data
– Indirect, incidental, or consequential damages
– Social media account suspensions or bans
– Third-party service failures
**Maximum liability limited to amount paid in the last 12 months.**
## 11. Indemnification
You agree to indemnify and hold us harmless from claims arising from:
– Your use of the Service
– Content you upload or publish
– Violation of these Terms or platform policies
– Infringement of third-party rights
## 12. Termination
### By You
– Cancel your account anytime from Settings
– Disconnect social media accounts to revoke publishing access
### By Us
We may suspend or terminate your account if:
– You violate these Terms
– You engage in fraudulent activity
– You abuse or overload our systems
– Required by law or platform policies
### Effect of Termination
– Access to the Service terminates immediately
– Your data will be deleted within 30 days
– Published content on social media remains (delete manually)
## 13. Changes to Terms
We may modify these Terms at any time. Changes are effective:
– Immediately for new users
– 30 days after notice for existing users
Continued use after changes constitutes acceptance.
## 14. Governing Law
These Terms are governed by French law. Disputes shall be resolved in the courts of Paris, France.
